Welcome to Bike Registry. These Terms of Service ("Terms") govern your use of our bicycle registration platform and related services. Please read these Terms carefully before using our services.

1. Acceptance of Terms

By accessing, registering for, or using the Bike Registry platform (the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Bike Registry.

2. Service Description

Bike Registry provides a platform for:

  • Registration of bicycles with unique serial numbers
  • Secure storage and management of bicycle ownership records
  • Ownership transfer facilitation through verification codes
  • Public search functionality for registered bicycles
  • Purchase and delivery of identification stickers with QR codes
  • Secure communication between bicycle owners and searchers

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

3.2 User Data Collection

By creating an account, you authorize us to collect and process:

  • Personal information (name, email address, phone number, physical address)
  • Authentication credentials
  • Profile information and preferences
  • Communication history and messages
  • IP addresses and device information
  • Usage data and analytics

4. Bicycle Registration and Data

4.1 Bicycle Information

When registering a bicycle, you may provide:

  • Serial number (required and must be unique)
  • Brand, model, year, and color
  • Photographs of the bicycle
  • Purchase receipts or proof of ownership
  • Location information (country and city)

4.2 Data Accuracy and User Responsibility

You are solely responsible for the accuracy and completeness of all bicycle information you provide. Bike Registry:

  • Does not verify the accuracy of bicycle data entered by users
  • Does not authenticate ownership claims or documentation
  • Does not guarantee that registered information is correct, complete, or up-to-date
  • Is not liable for any consequences arising from inaccurate, incomplete, or fraudulent data

You acknowledge that the Service relies on user-submitted information and that we cannot and do not independently verify all data.

4.3 Data Visibility

  • Bicycle information may be searchable by other users through our public search feature
  • Personal contact information is never publicly displayed
  • Search activities are logged and visible to bicycle owners for transparency

5. Ownership Transfers

5.1 Transfer Process

Ownership transfers require dual confirmation:

  • The current owner initiates the transfer and receives a unique transfer code
  • The new owner must enter the transfer code to complete the transfer
  • Transfer codes expire after 24 hours for security purposes

5.2 Transfer Responsibilities

You acknowledge that:

  • Bike Registry facilitates but does not guarantee ownership transfers
  • We are not party to any sale, purchase, or transfer agreements between users
  • Verification of ownership and transfer legitimacy is the users' responsibility
  • We are not liable for disputes, fraud, or issues arising from transfers

6. Orders and Payments

6.1 Product Orders

The Service offers physical products for purchase, including:

  • QR code identification stickers
  • Related bicycle identification materials

6.2 Payment Processing

  • Payments are processed securely through Stripe, a third-party payment processor
  • You must provide valid payment information
  • All prices are displayed in the applicable currency (EUR, SEK, or other supported currencies)
  • Prices include applicable taxes where required by law

6.3 Payment Data

When you make a purchase, we collect:

  • Billing and shipping address information
  • Payment card information (processed by Stripe; we do not store complete card details)
  • Transaction history and order details
  • Email address for order confirmations and receipts

Your payment information is subject to Stripe's privacy policy and terms of service in addition to these Terms.

6.4 Order Fulfillment

  • Orders are typically processed and shipped within 5-10 business days
  • Shipping times vary by location and carrier
  • We are not responsible for delays caused by shipping carriers, customs, or force majeure
  • Order tracking information will be provided when available

6.5 Refunds and Returns

Please refer to our Return Policy for information about refunds, returns, and cancellations.

7. User Conduct and Prohibited Activities

You agree not to:

  • Provide false, inaccurate, or misleading information
  • Register bicycles you do not own or have no authorization to register
  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Harvest or collect information about other users
  • Use automated systems (bots, scrapers) without our written permission
  • Infringe on intellectual property rights
  • Upload malicious code, viruses, or harmful content
  • Impersonate any person or entity

8. Intellectual Property Rights

8.1 Service Content

Unless otherwise stated, Bike Registry owns all intellectual property rights in the Service, including:

  • Website design, layout, and user interface
  • Software, code, and algorithms
  • Logos, trademarks, and branding
  • Documentation and content we create

8.2 User Content

You retain ownership of content you submit (bicycle photos, descriptions, etc.). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.

8.3 License to Use Service

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

9. Limitation of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Liability for Data Accuracy

WE ARE NOT RESPONSIBLE FOR:

  • The accuracy, completeness, or reliability of user-submitted data
  • Verification of ownership claims or bicycle information
  • Disputes between users regarding bicycle ownership or transfers
  • Loss or theft of bicycles, whether registered or not
  • Any damages or losses arising from reliance on information in the Service

9.3 Limited Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIKE REGISTRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Unauthorized access to your account or data
  • Errors, mistakes, or inaccuracies in content
  • Any conduct or content of third parties on the Service
  • Interruption or cessation of the Service

9.4 Maximum Liability

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or €100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bike Registry, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Any content you submit to the Service
  • Any false or inaccurate information you provide

11. Data Protection and Privacy

We are committed to protecting your privacy and complying with applicable data protection laws, including GDPR. Please review our Privacy Policy and GDPR Compliance documents for detailed information about:

  • Your rights regarding your personal data

12. Third-Party Services

The Service integrates with third-party services, including:

  • Stripe for payment processing
  • Cloud storage providers for file hosting
  • Email service providers for notifications

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or policies of third-party services.

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

13.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice, for any reason including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Extended periods of inactivity
  • Requests from regulatory or government agencies

13.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease immediately
  • We may delete your account and data in accordance with our data retention policies
  • Provisions of these Terms that by their nature should survive termination shall survive, including liability limitations, indemnification, and dispute resolution

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on the Service
  • Sending an email notification to your registered email address
  • Displaying a notice on the Service

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

15. Geographic Restrictions

The Service is operated from Finland and intended for users in the European Economic Area. We make no representation that the Service is appropriate or available for use in other locations. If you access the Service from outside the EEA, you do so at your own risk and are responsible for compliance with local laws.

16. Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.

16.2 Jurisdiction

You agree that any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Finland.

16.3 Informal Resolution

Before initiating formal proceedings, you agree to contact us to attempt to resolve the dispute informally.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, GDPR Compliance document, and Return Policy, constitute the entire agreement between you and Bike Registry regarding the Service.

17.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
